These Rules govern the Booth activities and Raffle taking place at the Street Fighter 6 booth at the Evo 2023 Convention (“Booth”), operated by Capcom U.S.A., Inc. (“Capcom”) and its vendors. By visiting the Booth or participating in the Booth Games or Raffle, you agree to follow these Rules and accept as final any decisions by Capcom or its vendors regarding these Rules, the Booth, or the Raffle.
- Eligibility Requirements. The Booth, Booth Games, and Raffle are open to attendees of Evo 2023 Convention who are at least 13 years or older (“Participants”), except that the following individuals are not eligible to participate in the Raffle: (i) Capcom employees, directors and officers, and their immediate families (spouses, siblings, parents, and children) and household members, (ii) Capcom’s vendors, distributors, agents, third party entities, contractors, hosts, or any other individuals involved in the implementation, execution, and hosting of the Booth (“Booth Entities”), or (iii) “Beat-a-Pro” celebrity participants who may appear at the Booth.
No purchase is necessary to visit the Booth or participate in the Booth Games or Raffle. A purchase will not improve the chances of winning.
- Period. The Booth, Booth Games and Raffle will be open during Evo 2023 Convention on August 4-5, 2023 (the “Period”). The Booth and Booth Games will be open from the hours of 9 a.m. to 7 p.m. PDT each day. Raffle entries must be received by 5 p.m. PDT on August 5, 2023.
- Booth Games and Cammy Cash. During the Period, the Booth will host a number of games and activities (the “Booth Games”) including Street Fighter 6, a Street Fighter arcade kiosk, Pop-A-Shot basketball, a photo booth, and a “money” Whirlwind featuring Cammy Cash. Booth Games may be subject to change. Participants in the Booth Games will have the opportunity to win the equivalent of arcade tickets (known as “Cammy Cash”) which may be exchanged for arcade-style prizes (“Arcade Prizes”) at the Booth. Additional terms regarding each Booth Game, including the amount of Cammy Cash provided to winners, are subject to change and will be identified at the Booth. Arcade Prizes and their cost in Cammy Cash are subject to change and will be identified at the Booth. All Cammy Cash must be exchanged before the Booth closes at 7 p.m. PDT on Saturday, August 5, 2023. Cammy Cash has no monetary value and may not be exchanged for cash.
- Raffle. Participants who wish to enter the Raffle (“Raffle Entrants”) may exchange Cammy Cash to obtain raffle tickets for a chance to win one or more prizes (“Raffle Prizes”). Each Raffle ticket will cost ₡400 in Cammy Cash. Each Raffle Prize will have a separate entry pool to win that prize. There is no limit to the number of entries a Raffle Entrant may place other than earning the required Cammy Cash to exchange for the Raffle tickets. Odds of winning will depend on the number of eligible entries received in each Raffle pool. Raffle tickets are only available in exchange for Cammy Cash and may not be purchased with cash. Raffle tickets must be acquired before the Raffle closes at 5 p.m. PDT on Saturday, August 5, 2023, at which time the winners will be selected by random drawing.
Winning raffle numbers will be posted at the Booth and winners will be contacted via Discord. Winners must claim their Raffle Prize by either (i) claiming their prize at the Booth between 5 and 8 p.m. PDT on Saturday, August 5, 2023, or (ii) responding to Discord messages by 8 p.m. PDT on Saturday, August 5, 2023 to schedule a pickup time for the following morning, Sunday, August 6, 2023, between 9 a.m. and 12 p.m. PDT. If a winner fails to claim their Raffle Prize or respond to Discord messages by 8 p.m. PDT on Saturday, August 5, the winner forfeits the Raffle Prize and it will be given to an alternate winner selected in a random drawing from among the remaining eligible entrants in that Raffle pool.
- Raffle Prizes. The Raffle Prizes will be subject to change at Capcom’s sole discretion. Final Raffle Prizes will be identified at the Booth where Raffle entries are received. The tentative Raffle prizes and their estimated value(s) are:
- One (1) Razer Headset & Controller (estimated value: $399.98)
- One (1) Blanka Statue (estimated value: $605)
- One (1) Arcade1Up Gaming Kiosk (estimated value: $600)
- One (10) Street Fighter 6 Collector’s Edition Box (estimated value: $249.99)
- One (1) trip, comprised of round-trip airfare and hotel reservation for three nights, to attend the 2023 Capcom Cup Last Chance Qualifier (“CCLCQ”) & guaranteed entry to play in CCLCQ (together, the “CCLCQ Raffle Prize”) (estimated value: $5,000)
All Raffle Prizes are non-transferrable and may not be substituted or exchanged by the winner, except as described below as to the CCLCQ Raffle Prize. No cash alternative is available for any Raffle Prize. If the actual value of any Raffle Prize is ultimately lower than the estimated value stated above, the difference will not be awarded in cash. Raffle Prizes are provided “as is” and Capcom provides no warranty. Capcom arranges this Raffle in good faith but cannot accept any liability related to any Raffle Prize offered.
If required by law, the names of Raffle winners will be made available in response to inquiries sent to [email protected].
- Additional Terms Regarding CCLCQ Raffle Prize. Capcom will determine the airline and hotel in its sole discretion. All costs and expenses apart from round-trip airfare and hotel reservation (including but not limited to transportation to and from the hotel, meals, snacks, beverages, mini-bar, entertainment, tips, gratuities, souvenirs, personal expenses, incidentals, damage to hotel rooms, baggage fees, travel insurance, visa related costs, departure taxes and fees, any equipment to be used, and the like) will not be paid by Capcom and are the sole responsibility of the Raffle winner.
Raffle winners under the age of majority must travel on the same itinerary as his/her parent or legal guardian. Travel restrictions, conditions and limitations may apply. Travel arrangements are subject to availability and must be round trip. Capcom and the Booth Entities shall not be responsible for any damage to baggage or any cancellations, delays, diversions or substitutions or any acts or omissions whatsoever by the air carriers, hotels or other transportation companies or any other persons providing any of the services and accommodations necessitated by same.
In the event the winner of the CCLCQ Raffle Prize is unable or ineligible to attend and participate in the CCLCQ, the winner will be permitted to transfer the CCLCQ Raffle Prize to an individual of their choosing who is eligible and available to participate in the CCLCQ. Such transfer will be subject to confirmation and approval by Capcom in its sole discretion. No other substitutions, exchanges, or alternatives will be permitted.
- Taxes. Any federal, state or local taxes associated with the Raffle Prizes are the sole responsibility of the raffle winner. Raffle winners are advised to consult a tax advisor regarding the tax consequences of any prize. Capcom may also require Raffle winners to execute an Affidavit of Eligibility and Liability/Publicity Release, a Form W-9, Form W-8BEN, or such other applicable tax information form as disseminated by the Internal Revenue Service, and any required payment information forms (“Raffle Winner Forms”) in order to receive their Raffle Prize. If the winner is under the age of majority, the Raffle Winner Forms must be signed by the minor winner’s parent or legal guardian. Failure to timely return the Raffle Winner Forms within ten (10) business days or refusal to sign the Raffle Winner Forms will result in the Raffle Prize being forfeited and awarded to an alternate winner selected in a random drawing from among all remaining eligible entrants.
- Personal Information. Names, e-mail addresses, Discord contact information, phone numbers, or other similar personal data of Raffle Entrants will be collected and processed by Capcom, the Booth Entities, or Capcom’s agents and/or its related, affiliated, or subsidiary companies where it is necessary for Capcom to perform its obligation under these Rules. This may include processing of your data for the following purposes:
- For selection and notification of a winner;
- Awarding and/or shipping Raffle Prizes to the winners;
- Disclosure of the winners’ names in response to inquiries, if required by law.
In addition to the above purposes, we store your personal data included in messages sent or received by Capcom via e-mail or Discord for archival purposes, which is for our legitimate interests in keeping an archive of our general correspondence. Capcom may share your personal data with its contractors or other service providers solely for the purposes specified above. In addition, Capcom may share your personal data with other Capcom affiliates, including Capcom Co., Ltd., for the purposes specified above. Capcom will ensure that such recipients will be bound by appropriate safeguards, mainly either standard data protection clauses or binding corporate rules approved by the European Commission or EU-U.S. Data Privacy Framework.
- Release. By participating in the Booth Games and/or Raffle, you agree to release Capcom, its affiliates, all Booth Entities, and each of their directors, officers, employees and agents (together, the “Released Parties”) from any and all liability for any claims, costs, injuries, losses or damages of any kind arising from the Booth or your participation in the Booth Games or Raffle, including the use of your personally identifiable information pursuant to these Rules.
- Limitation of Liability and Choice of Law. You agree that (a) any and all disputes, claims and causes of action between you and Capcom arising out of, or connected with the Booth, Booth Games, or Raffle shall be resolved individually, without resort to any form of class action, and exclusively by the appropriate court located in San Francisco County, California; (b) any and all claims, judgments, liabilities and awards shall be limited to actual out-of-pocket costs incurred and in no event shall you be entitled to recover attorneys’ fees; and (c) under no circumstances will you be permitted to and you hereby waive all rights to claim or recover punitive, incidental, consequential and/or special damages, any and all rights to have damages multiplied or otherwise increased, and/or any other damages other than out-of-pocket expenses. SOME JURISDICTIONS DO NOT ALLOW LIMITATIONS OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES, SO THE ABOVE MAY NOT APPLY TO YOU. All issues and questions concerning the construction, validity, interpretation and enforceability of these Rules, your rights and obligations, or Capcom’s rights and obligations in connection with the Booth, Booth Games, or Raffle, shall be governed by, and construed in accordance with California law without regard to choice of law or conflict of law rules. Failure to enforce any term of these Rules shall not constitute a waiver of that term.
- Indemnification. YOU AGREE TO INDEMNIFY, DEFEND AND HOLD THE RELEASED PARTIES HARMLESS FROM ANY AND ALL CLAIMS, DEMANDS, DAMAGES, EXPENSES, COSTS AND LIABILITIES (INCLUDING REASONABLE ATTORNEYS’ FEES) AND LIABILITIES (INCLUDING SETTLEMENTS), BROUGHT OR ASSERTED BY ANY THIRD PARTY AGAINST THE RELEASED PARTIES DUE TO OR ARISING OUT OF YOUR PARTICIPATION IN THE BOOTH, BOOTH GAMES, OR RAFFLE.
- Cancellation. If for any reason the Booth, Booth Games, or Raffle (i) cannot be executed as planned, or (ii) infection by computer virus, bug, tampering, unauthorized intervention, fraud, action of entrants, technical failures or any other cause which in Capcom’s opinion corrupts or affects the administration, security, fairness, integrity, or proper conduct of the Booth, Booth Games, or Raffle, then Capcom reserves the right at its sole discretion to cancel, terminate, modify or suspend the Booth, Booth Games, or Raffle.
- Change of Terms. Capcom reserves the right to change any term of these Rules any time with or without any cause.
